by and between Toronto German Shepherd Dog Rescue, hereinafter referred to as "TGSDR" and

Hereinafter referred to as "Adopter".
IN CONSIDERATION of the payment of the sum of .............  the receipt of which is hereby acknowledged,

"The Adopter" does hereby understands, promises, and agrees to forever release, discharge, and covenant to hold harmless the "TGSDR" from any and all claims damages, costs, expenses, loss of services, actions and causes of action belonging to the Adopter, arising out of the adoption of the following German Shepherd Dog (GSD):

"The Adopter" hereby acknowledges the following:no representation as to the nature or conduct of the GSD, the nature and extent of potential legal liability or conceivable financial responsibility have been made by "TGSDR" to induce "The Adopter" to sign this Agreement. "The Adopter" agrees to abide by the TERMS OF ADOPTION as outlined below:

1.    NEUTERING.  The dog described above must be neutered or spayed.  "The Adopter" agrees that under no circumstances will the dog be used for breeding, including accidental breeding.  If the dog is not neutered/spayed prior to the adoption, "The Adopter" agrees to have the dog altered within 60 (sixty) days of adoption.  In the meantime, "The Adopter" agrees to take any and all precautions to keep the dog from having or siring a litter.  "The Adopter" shall within seven (7) days of surgery forward to '"TGSDR" the veterinary certificate of the sterilization.

2.    Should "The Adopter" fail to comply with any of the terms hereof, he or she will at his or her own expense return the GSD back to the "TGSDR" or in the alternative allow a TGSDR representative to reclaim the GSD.  "The Adopter" waives any claim for a refund of any kind for any fees and /or expenses that "The Adopter" may had incurred.

3.    TRANSFER OF OWNERSHIP.  "The Adopter" agrees that he/she will not transfer the ownership of the said dog to any other person, firm or corporation without a prior written consent of "TGSDR".  Furthermore, "The Adopter" is required to notify the "TGSDR" within 72 hours in the event of the death of the GSD.  In addition "The Adopter" agrees to notify "TGSDR" immediately if the GSD is lost for more than 24 hours.

4.    CARE. "The Adopter" agrees to:

• a.    keep the GSD as a family member and companion and not a kennel or yard dog,
  
• b.    never leave the GSD chained or on a tie-out,
  
• c.    never permit the GSD to roam free in an unfenced area without direct adult supervision
  
• d.    provide all veterinary care necessary for the dog's good health,
  
• e.    obtain local dog license and follow local by-laws regarding the keeping of the dog,
  
• f.    assume all responsibilities for the GSD including but not limited to food bills, health care, and general well-being
  
• g.    provide a training plastic crate sufficient to comfortably accommodate the GSD for at least first three months of ownership,
  
• h.    adopt the GSD "as is" and assume all responsibility for treatment of any and all existing conditions and those that may subsequently occur,
  

5.    HEALTH.  If the GSD has a known medical problem it is listed as Addendum at the end of this agreement "The Adopter" acknowledges that he or she understands the extent of the medical problem(s) and the recommended treatment specified in the Addendum.  While "TGSDR" makes every effort to provide all medical information, no guarantee can be or is made as to the health of any dog offered for adoption and "TGSDR" shall not be held responsible for any medical expenses that may subsequently be incurred by "The Adopter".

6.    TEMPERAMENT.  "TGSDR" makes no explicit guarantees regarding the temperament of the GSD.  The GSD is adopted "as is" and "The Adopter" assumes all responsibility for any and all existing conditions and temperament changes that may occur.  "TGSDR" cannot and does not guarantee the temperament of the GSD nor does "TGSDR" guarantee that the dog is housebroken.

7.    TRAINING.  No electric training collar will be used at any time without a written consent of "TGSDR".  "The Adopter" shall under no circumstances physically punish the dog.  "The Adopter" will consult with the "TGSDR" first as to the appropriate ways of dealing with specific behavioral problems.  "The Adopter" will refrain from physical abuse and any other inhumane treatment and will prevent other adults and children from teasing or physically abusing the GSD.

8.    CHANGE OF ADDRESS AND COMPLAINTS.  "The Adopter" agrees to give written notification to "TGSDR" within ten (10) days of any change of address or any change of circumstances that will affect the GSD, as well as notice of any incident involving police, Animal Control or SPCA.

9.    VALUE. "The Adopter" agrees that the value of the GSD is determined to be $500.

10.    EUTHANASIA.  The Adopter will euthanize the GSD for medical reason only as attested to by a licensed veterinarian, and with the written consent of "TGSDR".  If "The Adopter" euthanizes the GSD without the "TGSDR"'s consent, "The Adopter" agrees to pay to "TGSDR" damages in an equal amount to the value of the GSD as stated in this Agreement, together with any cost and expenses related to the matter reasonably incurred by "TGSDR" including attorney's fees.  "Euthanizing" the dog, means intentionally putting the animal to death by any method including lethal injection.

11.    TRANSPORTATION. "The Adopter" agrees not to permit the GSD:

• a.    to ride in the back of an open pickup truck other than in the secure crate,
  
• b.    to remain unattended in any vehicle for any length of time,
  
• c.    to be flown in an airplane between 9am and 8pm when temperature at either departure or arrival airport is expected to be above 22 degree Celsius

12.    INSPECTIONS. "The Adopter" will allow "TGSDR" a reasonable access to the GSD to assure that it has integrated to it's new environment and it's new family and to ensure the compliance with the terms of this agreement.

13.    CHILDREN.  The GSD is not to be left unattended with children under the age of fourteen (14) years at ANY time.

14.    TITLE.  Notwithstanding the other terms of this agreement as to ownership and control, the parties agree that "TGSDR" shall retain title to the animal but only limited to and solely for the express purpose of assuring the well being of the GSD according to the Terms of this Adoption Agreement.

15.    RIGHT TO RECLAIM.  "The Adopter" agrees that "TGSDR" has a right to reclaim the GSD at any time because of neglect, abuse, inadequate care, breach of this agreement, or lack of integration into Adopter's family as determined by the "TGSDR".  "The Adopter" agrees to relinquish custody of the GSD immediately upon request.  In the event that such action is necessary "The Adopter" hereby waives any claim for a refund of any kind for any fees and expenses that may have been incurred.

16.    DISCLAIMER.  "TGSDR" gives no warranty, express or implied as to the description, quality, personality, temperament, physical condition, suitability for any purpose of the GSD provided for adoption.

17.    LIFETIME SUPPORT.  "TGSDR" will provide a lifetime phone and/or e-mail support to help with the integration of the GSD into "The Adopter"'s family and with GSD's well being throughout its entire life.
